What the April 22 Rescheduling Order Means for Your Books Right Now

On April 22, 2026 the federal government did something it has not done since 1970 — it changed how cannabis is classified. And if you own a cannabis business, that change has a direct impact on how much you owe in taxes this year.

The Department of Justice and the DEA issued a final order immediately placing both FDA-approved products containing marijuana and marijuana products regulated by a state medical marijuana license in Schedule III of the Controlled Substances Act.¹

What does that actually mean for your business?

For years, cannabis business owners have been operating under one of the most punishing tax rules in the entire tax code — Section 280E. Section 280E of the Internal Revenue Code disallows deductions and credits for businesses trafficking in Schedule I or II controlled substances.² That means no deducting rent. No deducting payroll. No deducting marketing. Every expense you had was coming straight out of your pocket with no tax relief.

I have seen cannabis clients overpay by tens of thousands of dollars because nobody was tracking their cost of goods correctly. That is not a small number — and it is completely avoidable with clean books and someone who knows what they are doing.

That changes now — at least for state-licensed medical cannabis operations.

With rescheduling now effective, Section 280E no longer bars deductions and credits for state-licensed medical cannabis operations.² This is enormous. We are talking about potentially tens of thousands of dollars back in your business depending on your size and structure.

What about recreational cannabis?

Not yet. Recreational marijuana remains unaffected for now. The DEA will hold a new administrative hearing beginning June 29, 2026, to evaluate the broader rescheduling of all marijuana — including recreational products.³ If that process moves forward on schedule, a final rule could be published as soon as late 2026 — though litigation could push that well into 2027 or beyond.¹

What should you do right now?

My advice? Work with your tax advisor now to figure out if you should file amended returns and start tracking deductible costs properly.²

There are several critical steps cannabis business owners need to take right now — from evaluating amended returns and potential retrospective tax relief, to understanding how the new rules apply to your specific operation, to making sure you do not miss key deadlines that are already approaching.

The details matter here and they are different for every business. Mixed operators, medical-only dispensaries, and adult-use businesses all have different considerations under this new framework.

This is not the time to wait and see. The cannabis industry has been operating with one hand tied behind its back for years and the rules just changed. The businesses that move quickly and get their financial house in order right now are the ones that will benefit most.

Rescheduling does not automatically put money back in your pocket. Clean records, properly categorized expenses, and a bookkeeper who understands the cannabis industry does. The law changed. Now your books need to catch up.
